Application for registration with the land registry

Ownership of real estate under a contract is acquired by registration in the land registry. I prepare the application, check the annexes and file it with the land registry office. During the proceedings I follow the office's requests and respond within the deadlines it sets.

In practice

How registration proceedings work

Registration proceedings begin with an application for registration. It identifies the applicant and the parties, the property and the right to be registered. The contract and other documents proving the entitlement to registration are attached to it.

The annexes include a contract with officially certified signatures or a contract authorised by an attorney. Depending on the case, there may also be proof of payment of the administrative fee or the consent of another person. I check the annexes for completeness before filing.

The land registry office reviews the application. If it has defects that can be remedied, the office suspends the proceedings and asks for them to be remedied within a set deadline. For example, an annex may be missing or the details may not match.

If the defects are not remedied in time, the office may reject the application. If it allows registration, the legal effects arise as of the day the application was filed. That is why the application should be complete when it is filed.

Procedure

How the filing works

I keep you informed at every step, from the first check of documents to notice of the result.

  1. Review of documents

I check the contract, the title deed extract and the annexes so that the application contains what the land registry office requires. Defects found at this stage can be corrected without suspension of the proceedings.

  2. Preparing the application

I prepare the application for registration and determine which administrative fee applies and in what amount. I show you the application for checking before it is filed.

  3. Filing

I file the application electronically or on paper. The administrative fee is paid to the land registry office; I explain when and how.

  4. Proceedings at the office

The land registry office decides whether to allow registration. I follow the proceedings and, if the office asks for defects to be remedied, prepare the response within the deadline the office has set.

Scope

What the filing includes

The scope may differ according to the particular case and the type of property.

  • Application for registration

An application with the details of the property, the parties and the legal relationship to be entered in the land registry. I compare the details with the title deed extract so that they match the contract.

  • Check of annexes

The contract, documents showing that conditions have been met and other annexes, depending on the case. In particular, I verify the certification of signatures or the authorisation of the contract, and that the annexes are complete.

  • Administrative fee

I determine the amount of the administrative fee (zák. č. 145/1995 Z. z., položka 11) according to the method of filing and explain how it is paid. The fee is paid to the office and is not part of my fee.

  • Monitoring deadlines

I monitor the decision deadline under § 32 zák. č. 162/1995 Z. z. and the deadlines set in the office's requests. I keep you informed of important dates.

  • Remedying defects

If the office asks for a supplement, I prepare a statement, additional annexes or a corrective addendum to the contract. I handle the request so that the deadline set by the office is met.

  • Notice of the result

After the office decides, I tell you the result and explain the next steps, for example handover of the property. If the office does not allow registration, I explain what options you have.

Defects

Typical reasons for a request to supplement

A request from the office can often be avoided by checking before filing. These are the areas I go through in advance for every application.

  1. Mismatched details

Details in the contract, for example the plot number, the area or a co-ownership share, do not match the details on the title deed extract.

  2. Missing annex

A document the office requires is missing from the application, for example the consent of another person, a power of attorney or proof of payment of the administrative fee.

  3. Signatures on the contract

The signatures are not officially certified and the contract is not authorised, or the certification does not meet the requirements. The office detects this defect at its first review.

  4. Indefinite contract

The contract does not identify the property, the price or the parties clearly enough, so the office cannot register it in the land registry.

  5. Pending note on the title deed

The title deed extract carries a note about other proceedings under way. I assess such a case individually, because applications are handled in the order in which they were filed.

  6. Missed deadline

The reply to a request was not delivered within the deadline the office set. Please send me the request as soon as you receive it so that I can prepare the supplement in time.

For real estate agents I offer a sale contract with an application for registration at a fixed price. The other prices are described on the pricing page.

Questions

Frequently asked questions about the application

How long does the land registry office take to decide?

The deadline is 30 days, or 20 days for a contract authorised by an attorney (§ 32 zák. č. 162/1995 Z. z.). In expedited proceedings the office decides within 15 days. If the office asks for defects to be remedied, the proceedings are extended.

What is the administrative fee for an application for registration?

€100 for a paper filing and €50 for an electronic filing. In expedited proceedings, €300 and €150. The values are stated as of 30 November 2026.

What happens when the office asks for defects to be remedied?

I prepare a statement, additional annexes or a corrective addendum to the contract. The office sets the deadline in its request, so please send it to me as soon as you receive it.

Does an attorney have to file the application?

No, a party to the proceedings may also file it. When I act for you, I check the application and annexes, file it and communicate with the office. The decision on registration always rests with the land registry office.

What is a pending note on the title deed?

It is a note on the title deed extract that proceedings concerning the property are under way and may change the registered details. I assess such a case individually and, before filing, explain what it means for you.

Which documents will I need?

The contract, a current title deed extract, the details of the parties and, depending on the case, other documents. I will specify the list after the first review of the matter, because it depends on the type of property and on how it was acquired.

From when is a registration effective?

If the office allows registration, its legal effects arise as of the day the application was filed. Ownership, however, arises only by registration, so I recommend linking handover of the property and payment in the contract to the office's decision.

Do you have a contract to register?

Send me the contract and the title deed extract. I will review them, point out any defects and propose how to file, together with my fee.
