Scope

What you receive

One set of documents needed to sign the contract and file the application for registration. The documents are based on the information you give me about the transaction.

  • Sale contract

A contract for the transfer of ownership of the property, based on the details of the parties, the property and the price. It sets out the agreed payment terms and the date of handover of the property.

  • Application for registration

An application for registration of the ownership right in the real estate cadastre, ready to file. The buyer acquires ownership only upon registration in the cadastre.

  • Handover protocol

A protocol on handing over the property, including meter readings. It records the condition on the day of handover, so the parties can refer back to it later.

  • Power of attorney for utilities

A power of attorney for the buyer to change the customer of record for energy and water. The buyer can then arrange the transfer with the suppliers without the seller being present.

  • Checklist

An overview of the steps and documents to verify before signing. These include, for example, the title deed extract, the identity of the parties and the method of paying the purchase price.

  • Corrective addendum on a registry request

If the cadastral office calls for the defects in the contract to be remedied, I prepare a corrective addendum. Scope as set out in the offer terms.

Process

How it works

Four steps from the instruction to the final set of documents. The agent and the client know at each step what comes next.

  1. Instruction through the form

In the form you state the property type, the municipality and cadastral area, and the party who is the client. Filling it in takes a few minutes.

  2. Documents by email

Once I accept the instruction I request the title deed extract, the details of the parties, the purchase price and the method of payment. You therefore send personal data by email, not through the form.

  3. Draft within 2 business days

I send the draft contract and the other documents. The period runs from receipt of complete documents, so please send them together.

  4. Comments and the final set

I incorporate your comments within the scope of the offer terms and deliver the final documents in Word and PDF. I issue the invoice once I have delivered the draft documents.

The cadastral department decides on an application for registration within 30 days of its receipt. Where the contract is authorised by an attorney, that period is 20 days.

Fees and deadlines

Administrative fee and registry deadlines

The administrative fee is paid to the state when the application for registration is filed. It is not included in the price of €80. The period for the decision is set by law and the proceedings are conducted by the cadastral office, not by me.

Outside the fixed price

These situations are not covered by the fixed price

They need a separate assessment and more work. Mark them in the form, I will assess them individually and send you a quotation.

  1. Pending-proceedings note on the title deed

The title deed carries a note of pending proceedings. The order of decisions and the signing procedure must be assessed separately.

  2. Enforcement proceedings

Enforcement proceedings affect the property or one of the parties. The procedure depends on the specific situation, so I first assess the entries on the title deed.

  3. Bankruptcy or restructuring

Bankruptcy has been declared or restructuring permitted in respect of a party's assets. Dealing with those assets is governed by a separate act.

  4. A minor is a party

A legal act involving a minor may require the approval of a court. You should therefore allow for additional documents and a longer preparation time.

  5. A party is a foreign national

A foreign party brings additional requirements, for example identification, a power of attorney or translation of documents. I adjust the signing procedure and the list of documents accordingly.

  6. Unsettled inheritance

The property forms part of an estate that has not yet been finally decided, or the owner is not registered in the cadastre. I therefore verify the registration status before preparing the contract.

  7. Co-ownership with a pre-emption right

When a co-ownership share is sold, the other co-owners have a pre-emption right under section 140 of the Civil Code. The procedure for offering the share to them must be taken into account when the contract is prepared.

  • Attorney-client confidentiality

The duty of confidentiality under section 23 of Act No. 586/2003 Coll. covers all the information in your instruction and continues after our cooperation ends.

  • Professional liability insurance

Liability insurance for damage caused in the practice of law.

  • Prepared by an attorney

I am responsible for the content of the contract as an attorney. I prepare it on the basis of the details of the specific transaction.

  • No referral commissions

I neither pay nor accept any reward for referring a client (section 29a of Act No. 586/2003 Coll.).

Questions

Frequently asked questions

Does the sale contract have to be done at a notary?

No. For registration in the land registry the signatures of the parties must be officially certified, or the contract must be authorised by an attorney under section 1a of Act No. 586/2003 Coll.. You agree which option to use before signing.

How long does registration in the land registry take?

The cadastral department decides on an application for registration within 30 days, within 20 days where the contract is authorised by an attorney, and within 15 days in the expedited procedure (section 32 of Act No. 162/1995 Coll.). The decision rests with the cadastral office, not with me.

Who pays the administrative fee?

The parties agree who pays the fee and I reflect that in the contract on the basis of your information. The administrative fee (€50 electronic / €100 paper) is not included in the price of €80.

What if the property has a pending-proceedings note or enforcement proceedings?

Such a case is not covered by the fixed price because it needs a separate assessment. Mark it in the form, I will assess it individually and send you a quotation.

What should I send and what should I not send?

The form needs only the property type, the municipality with its cadastral area and the client's side. I request the title deed extract and the details of the parties by email. Please do not send personal identification numbers or bank account numbers through the form.

Who is my client?

The client is the buyer or the seller, not the real estate agency. The agent brokers the transaction. Before accepting an instruction I therefore check whether a conflict of interest arises.

What if the cadastral office asks for the application to be completed?

If the cadastral office calls for the defects in the contract to be remedied, I prepare a corrective addendum. The scope of this service is set out in the offer terms.

How is payment made?

I issue an invoice once I have delivered the draft documents. The price is €80 excl. VAT (€98.40 incl. VAT) and does not include the land registry administrative fee.

Do you also prepare a reservation agreement?

A reservation agreement is not part of the fixed price. I prepare it individually, by agreement. If you need one for the transaction, say so in the note in the form.

Can we work together on a long-term basis?

Yes. I prepare every transaction of standard scope for the same fixed price of €80 excl. VAT. For each property please send a new instruction so that I can assess its specific documents.

Order a sale contract at a fixed price

The instruction itself is not a binding order. I first assess whether it is a standard case, and I reply within 1 business day.
